In order to maintain the normal teaching order of the school, safeguard the physical and mental health of international students, and promote the comprehensive development of international students, according to the ‘Law of the People's Republic of China on Higher Education’, ‘Law of the People's Republic of China on the Administration of Exit and Entry’, ‘Measures for the Administration of Schools on the Recruitment and Cultivation of International Students’, ‘Code of Conduct for Students of Higher Educational Institutions’ and the relevant provisions of the management of the students of Binzhou Polytechnic, and combining with the actual situation of the school, the regulations are formulated hereby.

These regulations are applicable to international students (academic students only) who receive education in Binzhou Polytechnic. The school will take disciplinary actions against students according to the seriousness of their disciplinary offences and faults, and in accordance with the principles of sufficient evidence and appropriate punishment.

Chapter I. 

Types and application of disciplinary action

Article 1 Disciplinary sanctions imposed on students by the school shall be commensurate with the nature of the student's disciplinary offence and the seriousness of the fault. The types of disciplinary actions are divided into:

　　(1) Warning;

　　(2) Serious warning;

　　(3) demerit;

　　(4) probation;

　　(5) Expulsion from school.

Article 2 If two or more persons commit a joint disciplinary offence, they shall be dealt with by separate judgements in accordance with the circumstances of each case.

Article 3 If any of the following circumstances applies, the disciplinary action may be carried out in a less severe manner:

      (1) After violating the discipline, the student voluntarily admits his/her mistake and takes remedial measures to correct it in time;

      (2) The disciplinary offence is due to coercion or enticement by others.

Article 4 If any of the following circumstances exists, the punishment may be heavier:

      (1) retaliation against informants and witnesses;

      (2) Those who harbour other disciplinary offences;

      (3) Those who have repeatedly violated school regulations and received disciplinary actions and do not change after education;

      (4) Plotting and coercing others to violate discipline;

      (5) Those who, after violating discipline, have a very poor attitude of admitting mistakes, refusing to accept education or repeatedly failing to change their behaviour;

      (6) During the period of disciplinary action, the disciplinary offence occurs again;

      (7) Multiple disciplinary offences at the same time.

Article 5 Damages or personal injuries caused by students in the course of disciplinary offences shall be compensated by the offending students in accordance with their responsibilities for the damages, medical expenses and other costs, and those who have violated Chinese laws shall be dealt with in accordance with the provisions of the law.

Article 6 Students shall be subject to disciplinary actions in accordance with these provisions if they have committed any disciplinary offences during their study at school, whether on or off campus.

Chapter II. 

Disciplinary offences and sanctions

Article 7 Those who violate the Constitution of the People's Republic of China and disturb the order of the school and society. If the circumstances are minor and the person can understand and correct his or her mistakes after education, he or she shall be placed on probation; if the circumstances are serious or if the person persists in failing to correct his or her mistakes after education, he or she shall be expelled from the school.

Article 8 Those who have violated the laws and regulations of the People's Republic of China and have been punished by the public security and judicial organs:

(1) If he or she is sentenced to a public security warning or fine, he or she shall be placed on probation.

(2) If a person is sentenced to public security detention, he/she shall be put on probation or above.

(3) Anyone who violates the national laws of the People's Republic of China and constitutes a criminal offence shall be expelled from the university.

Article 9 Anyone who violates the provisions of the regulations and systems relating to foreign-related management shall be subject to the following penalties:

(1) Those who have overstayed their visas or residence permits shall be given a warning or a serious warning, depending on the circumstances.

(2) Those who have long been in arrears with tuition and accommodation fees and still fail to pay without any reason after reminding them to do so shall be put on probation or expelled from the university.

(3) Those who do not respect Chinese customs and habits, and are of bad character and moral corruption shall be given a warning or more.

　  Article 10 The following penalties shall be imposed on persons who engage in fighting or gang fighting.

(1) Those who cause trouble

Causing trouble, resulting in adverse consequences, depending on the circumstances, shall be given a demerit (including demerit) or above up to expulsion from the school.

(2) Plotters

The person who plans a fight with others will be punished with a demerit (including a demerit) or more, depending on the circumstances, up to expulsion from the school.

(3) Fighter

If a student fights with others, or if he/she asks for money or property after the fight, he/she will be punished with a demerit (including demerit) or more, or expelled from the university, depending on the circumstances of the case. The punishment will be aggravated for those who fight with weapons.

(4) Participants

Taking sides or helping one party to fight in a group under the pretext of persuading the other party to fight, thus contributing to the development of the fight, shall be punished with a demerit (including demerit) or above up to expulsion from the school, depending on the circumstances of the case.

(5) False Witnesses

(i) Witnesses or other investigated persons who intentionally perjure themselves on behalf of others and cause difficulties in the investigation shall be given a serious warning or a demerit, depending on the seriousness of the case.

(ii) Anyone who participates in a fight and commits perjury shall be placed on probation (including detention) or above.

(6) Providing the murder weapon

Depending on the seriousness of the case, he/she will be given a demerit (including demerit) or above until expelled from the school.

(7) The person responsible for injuries caused by beating must compensate for the victim's medical expenses and other financial losses, and those who refuse to fulfil the responsibility of compensation will be subject to heavier punishment.

(8) gathering people to fight, depending on the seriousness of the case, will be given a demerit (including demerit) or more until the expulsion of school discipline.

(9) Students who invite people from outside the school to disrupt the order of school teaching or student life shall be held responsible for the responsibility of the inviters. Depending on the seriousness of the case, he/she shall be given a demerit or even expulsion.

Article 11 Gathering of people for gambling on campus, in addition to confiscation of gambling equipment and money, those who participate in gambling or provide gambling equipment and money for gambling shall, depending on the seriousness of the case, be given a demerit up to expulsion from the school.

Article 12 Violation of public morals and uncivilised behaviour shall be subject to the following penalties depending on the circumstances:

(1) Violating other people's portrait, privacy and personal rights, depending on the seriousness of the case, shall be given a serious warning up to expulsion from the university.

(2) Intentionally spreading or distributing pornographic pictures, videos and other information, or engaging in pornographic activities; depending on the seriousness of the case, the student shall be given demerits up to expulsion from the university.

(3) Disrupting order in public places such as meeting halls, classrooms, dining halls, flats, etc. Depending on the seriousness of the case, the student shall be given a serious warning (including serious warning) or more.

(4) Intentionally damaging the school's public signs or tearing up notices (notices, circulars, bulletins, seals, etc.) that are in effect shall be punished by a serious warning or a demerit.

(5) Concealing, destroying, or opening other people's letters, mails, or parcels. Depending on the circumstances of the case, a serious warning or a demerit shall be given.

(6) Carving, painting, sticking on buildings, walls, tables, chairs, public signs and other public objects, and intentionally dirtying or damaging them shall be punished by a warning.

(7) Making harassing phone calls to harass, intimidate or threaten others will be given a warning or serious warning, and repeated offenders will be given a demerit or probation.

(8) Intentionally defiling others with sewage or dirt, abusing, spreading rumours, or slandering others, in serious cases, shall be given a demerit or above.

(9) Smoking in public places of the school, if the student does not change after education, he/she will be given a warning, and if the student does not change, he/she will be given a demerit.

(10) Urinating and defecating in the school, throwing and dumping paper, fruit peels and dirt, etc., and those who do not change after education will be given a warning.

(11) Serious obstruction of public health and safety and failure to comply with the relevant regulations shall be punished by a demerit (including demerit) or above.

Article 13 Students shall not set up illegal organisations, hold illegal gatherings, or engage in any religious activities such as preaching or religious gatherings on campus. Students who set up illegal organisations and participate in or spread cults, religious gatherings and other activities on campus shall be given a serious warning or a higher sanction; in serious cases or where the main organisers are on probation, they shall be given a sanction ranging from probation to expulsion from the university.

Article 14 If a person steals or defrauds the State, a collective or an individual of property and has not yet committed a crime, he or she shall be subject to the following penalties, depending on the seriousness of the case:

(1) If the value is less than 500 yuan, a serious warning or a demerit shall be given;

(2) If the value is more than 500 yuan and less than 1,000 yuan, the person shall be given a demerit or placed on probation;

(3) If the value is less than RMB 1,000, but the student is a repeat offender, the student shall be given a demerit or probation; if the value exceeds RMB 1,000, the student shall be dealt with in accordance with the relevant laws and regulations of China.

(4) Providing information or tools for theft or fraud, providing perjury, harbouring stolen goods, or selling stolen goods; depending on the seriousness of the case, the student shall be given a demerit (including demerit) or more.

Article 15 Damage to public property shall be compensated for the economic loss (including repair costs) according to the actual price of the original object, and shall be given a warning or more depending on the seriousness of the case; intentional destruction of public and private property, campus facilities, and campus greening, landscaping, beautification, etc., in addition to doubling the compensation for the economic loss (including repair costs), according to the value of the destroyed property, shall be given a demerit (including a demerit) or more depending on the seriousness of the case, and shall be given a demerit (including a demerit) or more than the penalty of expulsion from the University.

Article 16 Anyone who violates the regulations related to the management of student residence shall be given the following punishments depending on the circumstances and consequences:

(1) Those who stay out at night without permission are given a demerit; those who fail to change after education are put on probation or expelled from the school. Those who rent a room without permission and do not report to the university will be given a warning or a higher punishment.

(2) A warning will be given to a person who stays in the flat without permission.

(3) Using open fire (burning rubbish, etc.) in the flat will be punished with a serious warning or above, depending on the seriousness of the case.

(4) Anyone who connects electric wires or network cables privately in the flat, or damages the fire fighting facilities without any reason, will be given a warning (including warning) to a demerit, depending on the seriousness of the case.

(5) Playing cards, making noise, playing games, playing music and other behaviours that affect the rest of others in the flat shall be punished with a warning (including warning) to a demerit.

(6) Storing flammable, explosive, corrosive or radioactive dangerous goods (such as liquefied gas canisters, firecrackers, alcohol, paraffin, petrol, sulphuric acid, nitric acid, etc.) in the flats will result in a serious warning or more, depending on the seriousness of the case, in addition to confiscation of the dangerous goods.

(7) Those who store or use all kinds of electric heating appliances (such as electric stoves, electric cups, electric rice cookers, heaters, etc.) and cooking utensils in the flats shall, in addition to the confiscation of the offending goods, be given a warning or more depending on the seriousness of the case.

(8) Keeping pets in the flats. Those who do not change after education will be given a warning (including warning) to a demerit point.

(9) Dumping debris into the washing pool, commode, sewer, corridor, etc., or throwing and pouring out of the window or balcony will be punished with a warning.

(10) Climbing over doors, windows or balconies to enter or leave the dormitory shall be punished by a warning or a demerit point depending on the circumstances.

Article 17 Anyone who commits any of the following acts and causes certain repercussions shall be subject to the following penalties:

(1) Those who use the Internet to log onto illegal websites and disseminate illegal text, audio and video materials, etc., fabricate or disseminate false or harmful information; attack or intrude into other people's computers and mobile communication network systems, resulting in economic losses or adverse impacts, shall be given a demerit or above, up to and including expulsion from the school.

(2) Refusing or obstructing state officials or school staff or student cadres to carry out their duties in accordance with the law or regulations shall be punished with a demerit.

(3) Carrying or concealing controlled knives shall be punished by a demerit or above.

(4) Those who organise strikes, drills, meals or sit-ins will be given a demerit to expulsion, depending on the circumstances of the case; any participant will be given a serious warning or more, depending on the seriousness of the case.

(5) Drinking and causing trouble and failing to listen to admonition, depending on the circumstances, will be given a serious warning to probation.

(6) Failure to comply with the book and periodical lending system, intentional tearing, ticking, defacing, theft of books and periodicals will be given a demerit.

(7) Impersonation of other individuals or organisations, or use of other people's documents for personal gain shall be punished with a serious warning or above;

(8) Students who have taken, planted, hidden or trafficked drugs shall be given a demerit (including demerit) or above depending on the circumstances.

(9) If a student insults another person or fabricates facts to slander another person, threatens another person's safety or interferes with another person's normal study and life with threatening letters, harassing phone calls or other means, he/she shall be given a serious warning or more; if he/she fails to change his/her behaviour after education or if he/she spreads other people's privacy and causes serious consequences, he/she shall be given demerits or even expelled from the university.

Article 18 Anyone who produces or alters forged certificates or documents, uses, provides or transfers false certificates or documents, or commits other fraudulent acts shall, depending on the seriousness of the case, be given a demerit (including a demerit) up to expulsion from the university.

Article 19 Anyone who abuses or assaults a faculty member without reason shall be placed on probation or expelled from the university, depending on the seriousness of the case.

Article 20 Anyone who violates the following disciplines shall, depending on the circumstances, be subject to the following penalties

(1) A warning shall be given to students who are absent from classes for 10 consecutive hours in a semester (one day's absence is counted as 6 hours) or for a total of 20 hours in a semester.

(2) If the number of consecutive absenteeism in a semester reaches 20 hours or the total number of absenteeism reaches 40 hours, the student shall be given a serious warning.

(3) If the number of consecutive absenteeism reaches 30 hours in a semester or the total number of absenteeism reaches 50 hours, the student shall be given a demerit.

(4) If the number of consecutive absenteeism in a semester reaches 40 hours or the total number of absenteeism reaches 70 hours, the student shall be put on probation.

(5) If the number of consecutive absenteeism reaches 60 hours in a semester or the total number of absenteeism reaches 90 hours, the student shall be expelled from the university.

(6) Students who violate discipline or cheat in the examination shall be punished according to the ‘Measures for Handling Violations in the Examination of Binzhou Polytechnic’.

Article 21 If a disciplinary offence is not listed in these regulations and a penalty must be imposed, a penalty may be imposed with reference to similar provisions in these regulations.

Article 22 The disciplined student shall be disqualified from all prizes and awards for that academic year, and the disciplinary materials shall be put into the disciplined student's personal file.

Chapter III. 

Disciplinary procedures

Article 23 The facts shall be investigated and evidence collected immediately after the discovery of a student's disciplinary offence. The investigation transcript shall state the names, ages, genders, majors, classes and other basic information of the investigator and the person under investigation. At the end of the investigation the investigation and the transcript shall be handed over to the investigated person for checking, allowing the investigated person to make corrections, and signing the name and date. The investigator shall hand over the raw materials of the investigation to the International College or the Student Affairs Office for retention.

Article 24 Before making a disciplinary or other unfavourable decision on a student, the student shall be informed of the facts, reasons and basis of the decision, and be informed of the right to make statements and pleadings, and be listened to the statements and pleadings of the student.

Article 25 The International College shall be responsible for organising the investigation and evidence collection of the general disciplinary offences of students, and shall put forward opinions on the handling of such offences to the university. Students' disciplinary incidents violating the Regulations of the People's Republic of China on Public Security Punishments and relevant laws and regulations shall be investigated by the Public Security and Defence Office of the university, with the assistance of the International College in the investigation, and the Public Security and Defence Office shall report the incidents to the university and the relevant departments, and the International College shall be responsible for making an explanation of the situation.

Article 26 The International College shall be authorised by the university to deal with the punishment below demerit (including demerit) and report it to the Office of Student Affairs for the record. For the disciplinary action of probation or expulsion, the International College shall put forward a proposal, which shall be examined by the Office of Student Affairs and reported to the university for research and decision.

Article 27 The disciplinary measures for students who violate the regulations on student registration shall be proposed by the International College and the Student Affairs Office according to the situation and reported to the university for research and processing.

Article 28 The disciplinary decision documents issued by the International College to the students themselves, the content of the disciplinary decision shall include:

(i) Basic information about the student;

(ii) Facts and evidence for the imposition of the sanction;

(iii) The type, basis and duration of the sanction;

(iv) The means and time limit for appeal;

(v) Other necessary contents.

Article 29 The decision on disciplinary action shall be directly informed and delivered to the student himself or herself, or delivered by mail, e-mail, etc.; for special cases where it is difficult to contact the student himself or herself, the website may be used to make announcements.

Article 30 the expulsion of students shall be expelled from school within 15 working days after the school disciplinary decision for leaving school procedures. The school of students expelled from the disciplinary decision shall be sent to the students themselves in a timely manner after the disciplinary decision, and at the same time reported to the department of education of shandong province and binzhou city entry and exit management department for the record.

Article 31 If a student has any objection to the school's treatment or disciplinary decision, he/she can submit a written appeal to the school's Student Appeal Committee within 10 working days after receiving the school's disciplinary decision, specifically in accordance with the ‘Binzhou Polytechnic Student Appeal Procedures’ and the relevant regulations on acceptance of student appeals.

Chapter IV. 

Dismissal of Students from 

Disciplinary Proceedings

Article 32 Time of release from disciplinary action

(1) A student on probation may not apply for removal of disciplinary action until 12 months have elapsed from the effective date of the decision on the sanction. Students in their final year who are on probation shall be placed on probation for a period of not less than six months.

(2) A student who has received a demerit, a serious warning or a warning as a disciplinary sanction may not apply for release from the disciplinary sanction until six months have elapsed from the effective date of the decision on the sanction.

Article 33 Procedure for the lifting of disciplinary sanctions

(1) If the period of punishment expires and the student has not committed any other disciplinary offences during the period of punishment, the student shall be relieved of the punishment upon application by the student and approval by the school.

(2) During the period of disciplinary action, students with outstanding performance (e.g. meritorious performance; actively participating in large-scale activities organised by the school and obtaining the top three grades; representing the school to participate in various competitions and obtaining awards of more than the second prize (including the second prize) at the municipal level, or more than the third prize (including the third prize) at the provincial level or the national level, etc.) may apply for an early release from the disciplinary sanction. Those who have been put on probation may apply for early release of disciplinary action 2 months in advance, and those who have been given a demerit or below may apply for early release of disciplinary action 3 months in advance.

(3) Graduation of graduating seniors who do not meet the requirements for lifting the disciplinary action before graduation will be deferred until the disciplinary action is lifted and graduation procedures are completed.

(4) After the lifting of the disciplinary action, students who have received commendations, awards and other rights and interests will no longer be affected by the original disciplinary action.

Chapter V. 

Annexes

Article 34 These regulations shall be interpreted by the School of International Studies.

Article 35 These regulations shall come into force on the date of their issuance.
